The Contract Services unit addresses the contractual (technical and quasi-legal) issues arising primarily out of Government building construction activity. Its role includes:
- Management of major disputation, default and insolvency matters arising out of building construction contracts (in accordance with the Capital Works Management Framework);
- Developing and implementing best-practice tendering and contract formulation;
- In consultation with industry, seeking innovative and cost effective approaches to project delivery; and
- Providing expert advice in respect of building procurement and contract related matters to ensure that decisions on building assets are informed, cost effective and in the long term interests of the Government.

The Department of Public Works' suite of building contracts includes several which use Standards Australia general conditions of contract, for which special conditions of contract have been drafted.
Where this occurs, only the special conditions of contract are available for downloading. The Standards Australia general conditions of contract can be obtained from the SAI Global WebShop.
The contracts are generic in nature, but typically contain sections which must be completed with project specific details before tenders are called. They must not otherwise be amended in any way without prior consultation and agreement with Contract Services. Where circumstances require it, Contract Services will provide conditions of tender and contract specifically tailored to particular government projects or applications.
A brief description of the contracts is provided below. For further information regarding the contracts and their application, see Attachment 1 of the Capital Works Management Framework guideline Procurement Strategy and Contract Selection.

DPW small scale minor works (102kb)
A lump sum contract used where the design and documentation has been completed by the principal and the contract value is less than $80 000. This contract is not suitable for use where the work includes asbestos removal or demolition work.
DPW minor works (138kb)
A lump sum contract used where the design and documentation has been completed by the principal and the contract value is less than $250 000.
DPW minor works with design (158kb)
A lump sum contract used where the contractor is also required to carry out design and/or documentation work and the contract value is less than $250 000.
DPW medium works (357kb)
A lump sum contract used where the design and documentation has been completed by the principal and the contract value is less than $750 000 for multiple trades or less than $1 million for a single trade.

A lump sum contract used where the contractor is also required to carry out design and/or documentation work and the contract value is less than $750 000 for multiple trades or less than $1 million for a single trade.
AS4305 Special Conditions of Contract and Annexure (To be read in conjunction with Australian Standard General Conditions of Contract AS 4305 – 1996)
A lump sum or schedule of rates contract used for medium works where the contract value is less than $1 million for multiple trades or less than $2 million for a single trade. Design and documentation work may be carried out by either the principal or the contractor.

AS2124 Special Conditions of Contract and Annexure (To be read in conjunction with Australian Standard General Conditions of Contract AS 2124 – 1992)
A lump sum or schedule of rates contract used for major works where the design and documentation has been completed by the principal and where the contract value exceeds $1 million for multiple trades or $2 million for a single trade.

A lump sum or schedule of rates contract used for major works where the contractor is also responsible for design and documentation work, and where the contract value exceeds $1 million for multiple trades or $2 million for a single trade.

Managing Contractor Two Stage Design and Construction Management (Negotiated Guaranteed Construction Sum)
Used for major or complex projects where early contractor involvement is required. The principal prepares a project brief, including a budget estimate and estimated completion time. During Stage 1, the Managing Contractor (MC) works collaboratively with the principal to revise the project brief and refine the design to meet budget and time constraints, and then submits a Guaranteed Construction Sum (GCS) Offer. If the offer is accepted, Stage 2 commences and the MC completes the design and documentation and manages the construction. The MC is paid fees for each stage, as well as the actual cost of construction (ACS), up to the accepted GCS. Where the ACS is less than the GCS, the MC may also receive a bonus share of the difference. Other available contracts include single stage, document and construct and construction management versions.

Supplementary Special Conditions of Contract
