Downloading contracts

Contract Services has made available a suite of generic building contracts. To assist in determining which contract is appropriate for your project, please read the information in the contract synopsis and consult the Capital Works Management Framework prior to downloading the contracts. Please note, the contract value thresholds are provided for guidance only and project specific characteristics should be taken into consideration when determining the most appropriate form of contract.

It is intended that the contracts be used ‘as is’, without modification by agencies, as alterations could fundamentally affect the allocation of risk or application of government policy.

Drivers behind the new contract
The construction industry in Queensland is currently characterised by market volatility, resource shortages and uncertainty in respect of subcontractors and the supply chain.  However, regardless of market conditions, the Queensland Government has an obligation to support a competitive, sustainable construction industry and to ensure that its significant capital works programmes are successfully delivered across all Departments.

In responding to the challenges of the current market, the Department of Public Works (DPW) has developed a procurement strategy aimed at attracting the interest of quality contractors, subcontractors and suppliers, while ensuring that the Government’s needs and obligations are met.

Special Conditions of Contract

AS4305 - 1996

A lump sum or schedule of rates contract used for medium works where the contract value is less than $1m for multiple trades or less than $2m for single trades. Design and documentation work may be carried out by either the principal or the contractor.

Special Conditions of Contract
for Design and Construct
AS4300 – 1995

A lump sum or schedule of rates contract used for major works where the contractor is responsible for design, documentation and construction work and where the contract value exceeds $1m for multiple trades or $2m for single trades. The principal is required to produce a performance specification which outlines the project requirements in sufficient detail to enable the contractor to design and build the project for a fixed price.

Managing Contractor
Design & Construction Management
(Guaranteed Construction Sum)

The contract documents available to be a downloaded are examples only and should not be used on Queensland Government building projects without contacting Contract Services on 3224 6187.

A two stage contract used for major or complex works. The Managing Contractor is responsible for the design, documentation and construction of the project and is paid a fee accordingly. Upon completion of the developed design, the Managing Contractor is required to submit a Guaranteed Construction Sum that is within the predetermined target.

The Managing Contractor is paid for the actual cost of construction up to the Guaranteed Construction Sum.

Contract Services has also developed a Managing Contractor – Documentation and Construction Management contract, which provides for the principal to retain control of the design team, and a Managing Contractor – Construction Management contract, which provides for the principal to retain control of the design and documentation teams. Government officers considering these or other alternative forms of the Managing Contractor contract should contact Contract Services.
